Terms of Service

Maddie provides an AI voice agent that answers inbound phone calls for your restaurant, and — based on your settings — can take reservations and orders, answer questions, transfer to a person, and send SMS or email confirmations. Features available to you depend on your subscription plan.

• You must provide accurate information and keep your account credentials secure.
• You are responsible for all activity under your account and for your staff’s use of it.
• You must be a business (or authorized representative) and at least 18 years old.

• Maddie is offered on recurring monthly subscription plans. Prices are shown at checkout and on our pricing page.
• Your subscription renews automatically each billing period until cancelled. By subscribing, you authorize us and our payment processor (Stripe) to charge your payment method for each period.
• Upgrades take effect immediately and are billed a prorated amount for the remainder of the current period. Downgrades take effect at the end of the current billing period.
• You may cancel at any time from the billing page; cancellation stops future renewals. Except where required by law, payments already made are non-refundable, and you retain access through the end of the paid period.
• If a payment fails, we may suspend or limit features until the balance is resolved.

When you subscribe, we provision a phone number for your restaurant through our telephony provider. The number is provided for use with the service; you do not own it, and it may be reclaimed if your subscription ends. Number porting, where offered, is subject to carrier approval.

SMS features depend on carrier registration (including US A2P 10DLC). Message delivery is not guaranteed and may be delayed or blocked by carriers outside our control.

To operate, Maddie processes, and may record and transcribe, the calls it answers. Recording and notification laws vary by jurisdiction and can require informing or obtaining consent from callers.

You are solely responsible for configuring the recording-consent disclosure and for complying with all applicable call-recording, telemarketing, and privacy laws in the places you and your callers are located. You agree to indemnify us against claims arising from your failure to do so.

You agree not to:

• Use the service for unlawful, fraudulent, harassing, or deceptive purposes.
• Use it for emergency services or any situation where failure could lead to injury or serious harm — Maddie is not a substitute for 911 or emergency dispatch.
• Send unlawful, unsolicited, or high-volume messaging in violation of TCPA, CAN-SPAM, or carrier rules.
• Reverse engineer, resell, or overload the service, or attempt to access data that is not yours.
• Misrepresent the AI as a specific real person in a deceptive way, or use it to impersonate others.

Maddie is an automated system. While we work to make it accurate and helpful, it can misunderstand a caller, make mistakes, or be unavailable. You are responsible for reviewing reservations and orders and for your restaurant’s final decisions. The service is provided to assist your operations, not to replace your judgment.

You retain ownership of the information you provide (menus, settings) and the data generated by your calls (reservations, orders, transcripts). You grant us a limited license to process this data to operate and improve the service, as described in our Privacy Policy. You are responsible for the accuracy and legality of the content you provide, including menu and pricing information.

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that every call will be answered or every message delivered.

To the maximum extent permitted by law, Maddie Labs LLC and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

You agree to indemnify and hold harmless Maddie Labs LLC from claims, damages, and expenses arising from your use of the service, your content, or your violation of these Terms or of any law — including call-recording, consent, and messaging laws.

You may stop using the service and cancel at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the service in a way that creates legal or security risk. On termination, your right to use the service ends and we may delete or de-identify your data as described in the Privacy Policy.

We may update the service and these Terms. For material changes to the Terms, we will update the date above and notify account holders. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the service will be brought in the state or federal courts located in Arizona. If any provision is found unenforceable, the rest remains in effect.
